Bei Unsicherheiten bzgl. des Alters des Gastes soll ein amtlicher Ausweis (Pass, ID, Ausl\u00e4nderausweis, F\u00fchrerschein) zur Alterskontrolle verlangt werden.<br \/>\n<a href=\"https:\/\/www.admin.ch\/opc\/de\/classified-compilation\/19320035\/index.html#a41\" target=\"_blank\" rel=\"noopener noreferrer\">Alkoholgesetz Art. 41<br \/>\n<\/a><a href=\"https:\/\/www.admin.ch\/opc\/de\/classified-compilation\/20143388\/index.html#a42\" target=\"_blank\" rel=\"noopener noreferrer\">Lebensmittel- und Gebrauchsgegenst\u00e4ndeverordnung Art. 42 Abs. 2<\/a><br \/>\n<a href=\"https:\/\/www.admin.ch\/opc\/de\/classified-compilation\/20101912\/index.html#a14\" target=\"_blank\" rel=\"noopener noreferrer\">Lebensmittelgesetz Art. 14<\/a><\/p>\n<p><strong>Werbeeinschr\u00e4nkung<\/strong><br \/>\nDie Werbung f\u00fcr alkoholische Getr\u00e4nke, die sich an Jugendliche unter 18 Jahren richtet, ist verboten. Ebenfalls gilt ein Werbeverbot f\u00fcr gebrannte Wasser an Veranstaltungen, an denen vor allem Kinder und Jugendliche teilnehmen.<br \/>\n<a href=\"https:\/\/www.admin.ch\/opc\/de\/classified-compilation\/20143388\/index.html#a43\" target=\"_blank\" rel=\"noopener noreferrer\">Lebensmittel- und Gebrauchsgegenst\u00e4ndeverordnung Art. 43<\/a><br \/>\n<a href=\"https:\/\/www.admin.ch\/opc\/de\/classified-compilation\/19320035\/index.html#a42b\" target=\"_blank\" rel=\"noopener noreferrer\">Alkoholgesetz Art. 42b<\/a><\/p>\n<p><strong>Strafrechtliche Massnahmen<\/strong><br \/>\nWer die rechtlichen Bestimmungen zur Abgabe und Verkauf nicht einh\u00e4lt, kann mit Busse oder Haft bestraft werden. Neben dem fehlbaren Verkaufspersonal betrifft dies auch Privatpersonen, die Alkohol oder Tabak einkaufen und an Kinder und Jugendliche weitergeben.<br \/>\n<a href=\"https:\/\/www.admin.ch\/opc\/de\/classified-compilation\/19370083\/index.html#a136\" target=\"_blank\" rel=\"noopener noreferrer\">Strafgesetzbuch Art. 136<\/a><\/p>\n<p><strong>Verwaltungsrechtliche Massnahmen<\/strong><br \/>\nBei Verst\u00f6ssen gegen die Jugendschutzbestimmungen kann die Bewilligungsbeh\u00f6rde Auflagen machen wie z.B. Einreichen eines Jugendschutzkonzeptes, Schulung des Personals, tempor\u00e4res oder definitives Verkaufsverbot von Alkohol sowie eine vor\u00fcbergehende Schliessung des Betriebes.<\/p>\n<p><strong>Bewilligung, \u00dcberwachung und Aufsicht<\/strong><br \/>\nF\u00fcr den Verkauf von Alkohol braucht es eine Bewilligung. Gesuche m\u00fcssen bei der Bewilligungsbeh\u00f6rde eingereicht werden. \u00dcber die Bewilligungskriterien und -auflagen entscheidet die Beh\u00f6rde.<\/p>\n<p><strong>Kantonale Bestimmungen<\/strong><br \/>\nDie Kantone m\u00fcssen die nationalen Bestimmungen einhalten, k\u00f6nnen aber auch weitergehende Regelungen einf\u00fchren. Auf kantonaler Ebene wird die Abgabe alkoholischer Getr\u00e4nke in den Gastgewerbegesetzen geregelt. Die Werbebestimmungen f\u00fcr Alkohol und Tabak k\u00f6nnen in separaten Gesetzen festgeschrieben werden. Die meisten kantonalen Bestimmungen betreffen Gesetze zum Mindestabgabealter, Sirupartikel, Bewirtung von Jugendlichen, die zeitliche Einschr\u00e4nkungen in der Nacht und das Werbeverbot im \u00f6ffentlichen Raum. Ein nationaler \u00dcberblick \u00fcber die kantonalen Gesetzgebungen finden Sie <a href=\"https:\/\/www.bag.admin.ch\/bag\/de\/home\/strategie-und-politik\/politische-auftraege-und-aktionsplaene\/politische-auftraege-zur-alkoholpraevention\/alkoholpraevention-kantone.html\" target=\"_blank\" rel=\"noopener noreferrer\">hier.<\/a><\/p>\n<p class=\"v1MsoNormal\"><b>Bestimmungen des neuen Tabakproduktegesetzes (voraussichtlich ab Herbst 2024)<\/b><\/p>\n<p class=\"v1MsoNormal\">Das neue Bundesgesetz regelt neben Tabakerzeugnissen auch elektronische Zigaretten, erhitzte Tabakprodukte, pflanzliche Raucherwaren, insbesondere THC-arme Hanfrauchwaren mit CBD sowie sogenannte \u00abgleichartige Produkte\u00bb (z.B. neue nikotinhaltige Produkte ohne Tabak).<\/p>\n<p class=\"v1MsoNormal\">Im Bereich des Jugendschutzes sind folgende Massnahmen festgelegt worden:<\/p>\n<ul>\n<li class=\"v1MsoNormal\">Tabakprodukte und elektronische Zigaretten d\u00fcrfen nicht an unter 18-J\u00e4hrige verkauft werden.
