ALKOHOLGESETZGEBUNG<\/strong><\/p>\n<p>F\u00fcr eine umfassende \u00dcbersicht zur Alkoholgesetzgebung im Kanton Luzern k\u00f6nnen Sie das &#8222;Gesetz \u00fcber das Gastgewerbe, den Handel mit alkoholischen Getr\u00e4nken und die Fasnacht&#8220; (<a href=\"https:\/\/srl.lu.ch\/app\/de\/texts_of_law\/980\">Gastgewerbegesetz, GaG<\/a>) konsultieren. Dieses regelt unter anderem die Abgabe von alkoholischen Getr\u00e4nken und enth\u00e4lt spezifische Bestimmungen zum Jugendschutz.<\/p>\n<p><strong>Jugendschutz:<\/strong><\/p>\n<ul>\n<li>Die Abgabe und der Ausschank von alkoholischen Getr\u00e4nken an Jugendliche unter 16\u00a0Jahren sind verboten.<\/li>\n<li>An Jugendliche unter 18 Jahren sind die Abgabe und der Ausschank von gebrannten Wassern oder verd\u00fcnnten alkoholhaltigen Getr\u00e4nken auf der Basis von gebrannten Wassern verboten.<\/li>\n<\/ul>\n<p><strong>Getr\u00e4nkeabgabeverbot<\/strong><\/p>\n<ul>\n<li>Mit alkoholischen Getr\u00e4nken d\u00fcrfen nicht bewirtet werden<br \/>\na. offensichtlich Betrunkene<br \/>\nb. Personen, die als alkoholkrank bekannt sind<\/li>\n<li>Ausserhalb von bewilligten R\u00e4umen gastgewerblicher Betriebe ist der Verkauf alkoholischer Getr\u00e4nke mittels Automaten untersagt.<\/li>\n<\/ul>\n<p><strong>Alkoholfreie Getr\u00e4nke (Sirupartikel)<\/strong><\/p>\n<ul>\n<li>In gastgewerblichen Betrieben mit Alkoholausschank sind mindestens drei alkoholfreie Getr\u00e4nke preisg\u00fcnstiger anzubieten als die gleiche Menge des billigsten alkoholhaltigen Getr\u00e4nks.<\/li>\n<\/ul>\n<p><strong>Testk\u00e4ufe:<\/strong><\/p>\n<ul>\n<li>Die zust\u00e4ndige Beh\u00f6rde kann Testk\u00e4ufe vornehmen oder vornehmen lassen. Sie arbeitet dazu mit Fachstellen des Jugendschutzes zusammen. Die Kosten tr\u00e4gt der Kanton.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/srl.lu.ch\/app\/de\/texts_of_law\/980\/versions\/686\">Gastgewerbegesetz (GaG<\/a>): Art. 17 Abs. 1 und 2; Art. 18 Abs. 1 und 2; Art. 19; Art. 17 Abs. 3<\/p>\n<p><strong>2. TABAK- UND NIKOTINGESETZGEBUNG<\/strong><\/p>\n<p>Das Tabakproduktegesetz und die Tabakprodukteverordnung gelten seit dem 1. Oktober 2024 auf nationales Ebene. Im Tabakproduktegesetz und der Tabakprodukteverordnung werden Verkaufs- und Werbevorschriften wie auch Meldepflichte f\u00fcr Tabakprodukte und elektronische Zigaretten festgehalten. Die Kantone k\u00f6nnen im Bereich Werbung, Verkaufsf\u00f6rderung und Sponsoring strengere Regeln erlassen als sie das Bundesgesetz vorsieht.
